1. Scope and Eligibility

The Site is intended for users located in the United States. The Site is for general informational and service-request purposes and is not intended for minors. You must be at least 18 years old to use the Site.

All Site Content is owned by Avorix or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, republish, distribute, modify, create derivative works from, publicly display, or exploit Site Content except as expressly permitted in these Terms of Use.
Avorix’s name, logos, and related marks are trademarks of Avorix. Use of our trademarks without written permission is prohibited.

3. Permitted Use of the Site

Avorix grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal or internal business purposes related to requesting or managing vehicle shipping services.
You may print or save limited portions of Site Content for your own internal reference, provided you do not remove proprietary notices.

4. Prohibited Uses

You agree you will not, and will not attempt to:

1. Use the Site in violation of any applicable law or regulation
2. Interfere with the Site’s operation or security
3. Access non-public areas of the Site without authorization
4. Upload malicious code, run exploits, or attempt to probe vulnerabilities
5. Use any automated means to scrape, crawl, spider, or harvest data from the Site without Avorix’s written permission
6. Use Site Content to train, benchmark, or develop artificial intelligence models, machine learning systems, or similar technologies without Avorix’s written permission
7. Impersonate another person or misrepresent your identity
8. Submit false, misleading, or fraudulent information through Site forms
9. Use the Site for competitive research, benchmarking, or building a competing service
10. Circumvent rate limits, access controls, or other protective measures

5. Quotes, Estimates, and Site Content Disclaimer

Information on the Site is provided for general service-request and operational purposes. While we aim to keep information accurate, Site Content may not always reflect real-time availability, market conditions, or operational constraints.
Any quote or estimate generated through the Site is based on information you provide and may change if:

1. Vehicle details are inaccurate
2. Locations, timing, or condition changes
3. Carrier availability or market conditions change

6. Third-Party Links and Services

The Site may include links to third-party websites or services. Avorix does not control and is not responsible for third-party content, policies, or practices. Your use of third-party websites is at your own risk and subject to their terms.

7. Communications and Mobile Messaging

By submitting your phone number, email address, or other contact information, you authorize Avorix to contact you regarding your request, order, scheduling, delivery coordination, support, and service-related notices.
SMS (Text Messages)
Avorix uses SMS for transactional messages only related to your request or order. We do not send marketing SMS messages.
You may opt out at any time by replying STOP. For help, reply HELP. Message and data rates may apply.
Call Recording
Phone calls may be recorded for quality, training, compliance, and dispute resolution. By continuing a call, you consent to recording.

8. Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Site, you consent to our privacy practices as disclosed there.

9. Disclaimer of Warranties

The Site and Site Content are provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, Avorix disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Site will be uninterrupted, error-free, or secure, or that defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by law, Avorix will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of (or inability to use) the Site, including loss of profits, loss of data, or business interruption.
Avorix’s total liability for any claim related to the Site will not exceed $100 or the amount you paid Avorix for Site access (if any), whichever is greater.
This limitation does not override any limitation of liability in the applicable service Terms & Conditions.

11. Indemnification

You agree to indemnify, defend, and hold harmless Avorix and its officers, directors, employees, and agents from any claims, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from:

1. Your use of the Site
2. Your violation of these Terms of Use
3. Your submission of false or unlawful information
4. Your violation of any third-party rights

12. Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to the Site, Site Content, or these Terms of Use will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules.
Arbitration will be conducted on an individual basis only. This arbitration provision survives termination of these Terms of Use.
Either party may bring an individual claim in small claims court if eligible.

13. Class Action Waiver and Jury Trial Waiver

You waive any right to bring or participate in a class, collective, or representative action against Avorix related to the Site or these Terms of Use.
If a dispute proceeds in court for any reason, you knowingly waive any right to a jury trial.

14. Governing Law and Venue

These Terms of Use are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Where arbitration does not apply, exclusive venue will be in state or federal courts located in Delaware.

15. Changes to These Terms of Use

We may update these Terms of Use at any time by posting an updated version on the Site. Continued use of the Site after changes become effective constitutes acceptance.

16. Termination

We may suspend or terminate your access to the Site at any time if we reasonably believe you have violated these Terms of Use or used the Site in an unauthorized manner.

17. Severability

If any provision of these Terms of Use is held unenforceable, the remaining provisions remain in effect.
