These Terms & Conditions (“Terms”) govern your access to and use of the Avorix Auto Transport website and services. By requesting a quote,
placing an order, submitting payment, or otherwise using our services, you agree to be legally bound by these Terms.
If you do not agree to these Terms, you must not use our website or services.

1. Definitions
“Avorix,” “we,” “us,” or “our” means AVORIX INC, doing business as Avorix Auto Transport.
“Customer,” “you,” or “your” means the individual requesting or purchasing vehicle shipping services.
“Vehicle” means the motor vehicle identified in your Order.
“Carrier” means an independent motor carrier that physically transports vehicles under its own operating authority.
“Order” means your request for Avorix to arrange vehicle transportation.
“Order Confirmation” means written or electronic confirmation of Order details.
“Bill of Lading” means the document issued by the Carrier at pickup and delivery noting Vehicle condition.
2. Scope of Services
Avorix Auto Transport coordinates vehicle transportation through independent Carriers.
Avorix does not transport Vehicles and does not take possession, custody, or control of any Vehicle at any time. Transportation services are performed exclusively by independent Carriers.
Avorix’s services are deemed fully rendered once a Carrier accepts an Order.
3. Role Disclosure
Avorix acts solely as a coordinator of vehicle transportation services.
Avorix is not a motor carrier and does not provide physical transportation. All transportation services are performed by third-party Carriers operating under their own authority, insurance, and responsibility.
Nothing in these Terms shall be construed to create an agency, partnership, joint venture, or employment relationship between Avorix and any Carrier.
4. Orders and Acceptance
All Orders are subject to acceptance by a Carrier.
Avorix reserves the right to refuse, cancel, or decline any Order prior to Carrier acceptance for any reason, including operational, safety, or compliance considerations.
All pickup and delivery dates provided are estimates only and are not guaranteed.
5. Pricing, Fees, and Payment
Pricing is based on the information you provide, including Vehicle type, condition, locations, and timing. Quotes are estimates and may change based on market conditions or corrected information.
You authorize Avorix to charge your selected payment method when a Carrier accepts your Order.
Payments are handled online unless otherwise stated. Except as expressly stated in Section 11, all payments are non-refundable once a Carrier accepts an Order.
You agree not to initiate chargebacks, payment reversals, or offsets for services that have been rendered or where a Carrier has been assigned.
6. Pickup and Delivery
Pickup and delivery are performed as close to the provided addresses as legally and safely possible.
If access restrictions prevent direct access, you agree to meet the Carrier at an alternate nearby location.
You or your authorized representative must be present at pickup and delivery and have legal authority to release and receive the Vehicle.
7. Customer Responsibilities
You are solely responsible for the accuracy of all Order details.
You must disclose, without limitation:
• Accurate Vehicle condition
• Modifications or oversize features
• Inoperable status
• Correct pickup and delivery information
Failure to provide accurate information may result in additional charges, delays, refusal of service, or cancellation without refund.
8. Vehicle Condition and Preparation
Vehicles must be operable unless disclosed and confirmed otherwise.
Vehicles must:
• Contain no more than ¼ tank of fuel
• Be free of loose or unsecured parts
• Have alarms disabled
You are responsible for any damage or delay caused by improper Vehicle preparation.
9. Personal Property
Personal items are transported at your own risk.
Neither Avorix nor any Carrier is responsible for loss or damage to personal property left in a Vehicle.
Carriers may refuse transport if personal property is present or improperly secured.
10. Delays and Force Majeure
Delays may occur due to weather, traffic, mechanical issues, governmental actions, labor issues, acts of God, or other events beyond Avorix’s control.
Avorix shall not be responsible or liable for delays, missed dates, or related expenses. Such events may suspend or delay performance without liability.
11. Cancellations and Refunds
Orders may be canceled without penalty prior to Carrier acceptance.
Once a Carrier accepts an Order, Avorix’s services are deemed rendered and fees become non-refundable.
Any refunds, if applicable, are limited strictly to unperformed services and shall not exceed the amount paid to Avorix.
12. Loss, Damage, and Claims
Carriers are solely responsible for loss or damage to Vehicles during transport.
All claims must be clearly noted on the Bill of Lading at delivery. Failure to do so constitutes acceptance of the Vehicle in satisfactory condition.
Claims must be filed directly with the Carrier. Avorix may provide administrative assistance but assumes no liability for Carrier claims.
Carrier cargo insurance coverage limits vary and are determined solely by the Carrier.
13. Limitation of Liability
To the maximum extent permitted by law:
Avorix’s total cumulative liability for any claim shall not exceed the amount paid to Avorix for its services related to the Order.
Avorix shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of use, loss of value, or loss of income.
14. Indemnification
You agree to indemnify, defend, and hold harmless Avorix from any claims, damages, liabilities, costs, or expenses arising from:
• Your breach of these Terms
• Inaccurate or incomplete information
• Vehicle condition or preparation
• Personal property left in the Vehicle
15. Communications, Call Recording, and SMS
Phone calls with Avorix may be recorded for quality, training, compliance, and dispute resolution.
By continuing a call, you expressly consent to such recording.
Avorix may send transactional SMS messages only related to your Order. Marketing messages are not sent via SMS.
You may opt out of SMS by replying STOP.
16. Electronic Communications and Consent
You consent to receive all communications, agreements, confirmations, and disclosures electronically.
Electronic records and signatures have the same legal effect as written documents.
17. Arbitration Agreement
Any dispute, claim, or controversy arising out of or relating to these Terms or Avorix’s services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Arbitration shall be conducted on an individual basis only and not as a class or representative action.
This arbitration agreement survives termination of these Terms.
18. Class Action and Jury Trial Waiver
You waive any right to participate in a class, collective, or representative action.
If a dispute proceeds in court, you knowingly and voluntarily waive the right to a jury trial.
19. Governing Law and Venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
Where arbitration does not apply, exclusive venue shall lie in state or federal courts located in Delaware.
20. Modifications
Avorix may modify these Terms at any time. Continued use of the website or services constitutes acceptance of the updated Terms.
21. Severability
If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.
22. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Avorix regarding the services.
